Convict prisoner not in court custody, only govt can order premature release, says Madras HC

The Madras High Court ruled that convicts cannot seek premature release or interim bail in court, as custody lies with the government post-sentencing. Dismissing petitions from Zubaitha Begum and others, the bench emphasized that the government holds the discretion for remission under the Tamil Nadu Suspension of Sentence Rules, 1982. The ruling clarifies the limits of judicial authority in such cases.
